Family Medical Leave Act Can be a Minefield for Employers According to Attorneys Geoffrey Lindley and Latosha Dexter

Memphis, TN (January 22, 2013)  – Writing in the December edition of HR Professionals Magazine,  attorneys Geoffrey Lindley and Latosha Dexter of Rainey, Kizer, Reviere & Bell PLC (Rainey Kizer) highlight many of the pitfalls employers face in complying with the Family and Medical Leave Act (FMLA).

Their article, “The Family and Medical Leave Act – Navigating a Regulatory Minefield,” (available at this link) notes that while the 2009 revisions of the FMLA “were intended to advance the purpose of the statute, they unfortunately often provide a source of frustration for human resource professionals.”  The attorneys report that, when advising clients on FMLA issues, they frequently refer to the regulations, and quite often to the case law.  They advise human resources professionals to do the same, and note that in particularly difficult situations obtaining legal advice may be warranted.

 

At Rainey Kizer, Lindley advises employers on issues concerning all areas of employment and human resource concerns, such as Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, the Family Medical Leave Act, the Age Discrimination in Employment Act, the Fair Labor Standards Act, and other laws applicable to employers.  He also litigates employment claims for employers and frequently speaks to attorneys and HR professionals at educational conferences and seminars on employment issues.  He is a graduate of the University of Tennessee School of Law, where he was an associate editor of the Tennessee Journal of Business Law.

 

Dexter’s practice focuses on employment law and local government law.  She is certified as a Senior Professional in Human Resources by the Society for Human Resources Management (SHRM) and frequently addresses SHRM chapters on human resources law.  While an employee of FedEx Express, she received the company’s Human Resources Award of Excellence.  Dexter is a graduate of the University of Tennessee School of Law, where she was a member of the law review.
